Terms of Service

1. Agreement

These Terms form a legal agreement between you (“Customer”, “you”) and Chilly Networks Technologies, operator of Chilly Proxy (“we”, “us”), governing access to our website, customer dashboard, wallet, checkout flows, and proxy subscription services. If you do not agree, do not use the service.

2. Eligibility & accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter a binding contract.
• You must provide accurate registration information and keep your login credentials confidential.
• You are responsible for all activity under your account, including actions by anyone you allow to use your credentials.
• One person or legal entity per account unless you are an approved reseller operating sub-accounts under your partner agreement.
• We may refuse registration, limit purchases, or close accounts at our discretion for fraud, abuse, or policy violations.

3. Digital delivery

All products are digital services. No physical shipment occurs. After payment confirmation, proxy credentials and usage controls are made available in your dashboard. Delivery time depends on payment method (wallet is instant; crypto depends on network confirmations). If provisioning fails, see our Refund Policy.

4. Services & plans

We sell access to proxy products as described on plan pages and in your dashboard (e.g. Budget Residential, Subscription packs, Premium Geo, IPv4 Unlimited, Residential IPv6, Datacenter IPv6). Each plan has specific limits: traffic (GB), speed (Mbps), billing cycle, geo targeting options, and expiry rules shown at purchase.

We do not guarantee that every target website or API will accept proxy traffic. Third-party platforms may block, rate-limit, or change behavior without notice. You are responsible for complying with each target’s terms of use and applicable law.

5. Billing, wallet & payments

• Prices are shown in USD unless stated otherwise. Taxes may apply depending on your location.
• Wallet balance can be used for eligible checkouts. Crypto payments are processed via third-party gateways; confirmation times depend on the network.
• Promotional codes and coupons are subject to their stated terms and may not be combined unless explicitly allowed.
• Failed provisioning after payment may result in an automatic refund (card to card, crypto to wallet) or support-assisted resolution — see our Refund Policy.
• Chargebacks filed without contacting support first may result in immediate suspension and denial of future service — see Payment integrity & fraud.

6. Payment integrity & fraud

You may pay for Chilly Proxy only with payment methods you are lawfully authorized to use. The cardholder, wallet owner, or crypto sender must be you or someone who has given you explicit permission to use that instrument for this purchase.

Prohibited payment conduct

• Using stolen, lost, skimmed, or otherwise unauthorized payment cards, bank accounts, or digital wallets.
• Card testing, BIN/CVV probing, or any attempt to validate stolen or synthetic payment credentials through our checkout.
• Misrepresenting your identity, billing address, or authorization at checkout or in a dispute.
• Using our proxies or website to facilitate payment fraud against third parties (including card-not-present fraud sites or credential-checking services).

Our response

• We may decline, hold, or cancel orders; reverse provisioning; suspend or permanently close accounts; and withhold refunds when we reasonably suspect payment fraud or policy violations.
• Confirmed or strongly suspected fraud is not eligible for refunds under our Refund Policy, including voluntary refund requests after delivery.
• Unauthorized chargebacks, false disputes, or “friendly fraud” may result in immediate termination, collection of amounts owed, and denial of future service.
• We may share relevant account, order, and technical data with payment processors, banks, card networks, and law enforcement as described in our Privacy Policy and as required by law.

7. Acceptable use

Your use must comply with our Acceptable Use Policy, which is incorporated into these Terms. Prohibited activity includes illegal conduct, fraud, malware, spam, credential theft, DDoS, and circumventing security of third parties.

8. Suspension & termination

We may suspend or terminate access immediately if we reasonably believe you have violated these Terms, the AUP, payment terms, or applicable law; if your account poses a security risk; or if required by a provider or legal process.

You may stop using the service at any time. Prepaid active plans generally remain usable until expiry unless terminated for cause. Account deletion requests are handled per our Privacy Policy.

9. Disclaimers & liability

The service is provided “as available” without warranties of uninterrupted uptime, fitness for a particular purpose, or error-free operation. Proxy availability depends on upstream providers and network conditions.

To the maximum extent permitted by law, Chilly Proxy is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, even if we were advised of the possibility.

Our total liability for any claim relating to the service is limited to the amount you paid us for the specific order giving rise to the claim in the three (3) months before the event, except where law prohibits such limitation.

10. General

• Changes: We may update these Terms; material changes will be reflected by the effective date. Continued use after changes constitutes acceptance.
• Entire agreement: These Terms, the AUP, Privacy Policy, and Refund Policy together govern your use.
• Governing law: These Terms are governed by the laws applicable to the operator of Chilly Proxy, without regard to conflict-of-law rules. Disputes should first be raised via support; courts of competent jurisdiction may hear matters that cannot be resolved informally.
• Severability: If any provision is unenforceable, the remainder stays in effect.
